Yes: New Mexico law defines an e-bike as having 'two or three wheels', so a pedal e-trike up to 750 watts needs no license, plate, registration or insurance. Ride on roads; a pedal-assist (Class 1) trike may use bike and pedestrian paths unless the city says no, but a throttle (Class 2) or 28-mph (Class 3) trike stays off paths unless allowed. Riders under 18 must wear a helmet.

A two- or three-wheel electric vehicle that doesn't meet the e-bike definition and can exceed 20 mph on motor power alone is an 'electric mobility device', which the Motor Vehicle Code expressly counts as a 'motor vehicle', so the normal license, registration/title and mandatory insurance rules apply. The 'moped' category (exempt from registration) is defined by a piston engine under 50 cc, so it does not fit electric trikes. An over-750 W trike limited to 20 mph fits neither category cleanly.

  • Whether the Motor Vehicle Code 'bicycle' definition (NMSA 66-1-4.2) includes e-bikes or three-wheel cycles, and thus whether bicycle road rules and the 2025 stop-as-yield rule apply to e-trikes, was not confirmed.
  • No statewide sidewalk rule for bicycles or e-bikes was reviewed; sidewalk riding is commonly regulated by city ordinance.
